These Terms of Service (the “Terms”) govern your access to and use of happytransport.net (the “Site”), operated by Happy Transport (Dan Mijailovic Transport INC; “Happy Transport,” “we,” “our,” or “us”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Use of the site
You may use the Site only for lawful purposes related to learning about our services, applying to drive for Happy Transport, requesting a freight quote, or otherwise interacting with our business. You agree not to:
- Use the Site in any way that violates federal, state, or local law;
- Attempt to gain unauthorized access to any portion of the Site, our systems, or other users’ data;
- Interfere with, disrupt, or impose an unreasonable load on the Site or its infrastructure;
- Use automated systems (bots, scrapers, etc.) to access the Site without our written permission;
- Impersonate another person or submit false information through forms on the Site.
Driver applications and submissions
When you submit a driver application or other form on the Site, you represent and warrant that the information you provide is accurate, complete, and your own. We may verify any information you submit, including by conducting background checks and pulling motor vehicle records, in accordance with the consent you provide and applicable law. Submitting an application does not create an employment or contractor relationship with Happy Transport.
Freight services
Nothing on the Site constitutes a binding offer of motor carrier services. Rates, capacity, and lane availability are confirmed only through signed shipping documents (load confirmation, broker-carrier agreement, or master service agreement) executed between Happy Transport and the shipper or broker. Motor carrier services we provide are subject to the Carmack Amendment, our master agreements, and applicable federal and state law.
Broker complaints
If you are a broker or shipper and wish to file a complaint regarding a shipment or payment, please contact us at safety@happytransport.net with the relevant load and reference numbers, and we will respond promptly.
Intellectual property
The Site — including its text, graphics, logos, images, and code — is owned by Happy Transport or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, or create derivative works from any part of the Site without our prior written permission, except that you may view and print pages for your personal, non-commercial reference.
Third-party links and services
The Site may contain links to third-party websites or services that are not owned or controlled by Happy Transport. We are not responsible for the content, policies, or practices of any third-party sites. Your use of any third-party site is at your own risk and subject to that site’s terms.
Disclaimer of warranties
The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that the Site will be error-free or that defects will be corrected.
Limitation of liability
To the maximum extent permitted by law, Happy Transport and its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim related to the Site shall not exceed one hundred U.S. dollars ($100). Liability for motor carrier services is governed separately by our shipping documents and applicable law.
Indemnification
You agree to indemnify and hold harmless Happy Transport and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another party.
Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the jurisdiction of those courts.
Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects when the Terms were last revised. Continued use of the Site after changes are posted means you accept the updated Terms.
